Terms of service
This Family Business Free Beer for Life Agreement (“Agreement”) is being entered into on the date of purchase hereto by the purchaser (“me”, “I” or “family member,” “member”) and Family Business Beer Company LLC (including its subsidiaries, “Family Business” or “you” and, together with me, “we” or “us”) in connection with my purchase of an Official Family Member membership. We are entering into this Agreement to provide me with certain additional benefits as an Official Family Member.
1. Accordingly, we agree subject to the conditions described later in this Agreement, I will be entitled to the following benefits as an Official Family Member (collectively, “ Member Privileges”):
a. Prepaid Craft Beer and non-alcoholic drinks. I will be provided with one prepaid draft beer per day on premises at any Family Business Beer Co. location for as long as the Family Business Beer Company’s premises remains open for business. I will not incur any additional charges for my pre-paid beverage provided under the Official Family Member program. However, not all products will be available at all times for consumption under the Free Beer for Life program due to availability or other reasons. .
b. A personalized Official Family Member membership card with member number. Should a replacement card be needed there is a $75 fee to be paid by the card holder.
c. One bottle of any specialty released beer reserved for member to pick up at our Dripping Springs location within a six-month period. Note: Family Business Beer Company cannot legally ship beer direct to consumer so bottles must be picked up in person, or the bottle can be released to a third party of Member’s choosing with member’s written permission. Bottles not picked up within the six-month pickup window will be released back to Family Business Beer Company at no cost to company.
d. 15% off on all Family Business Beer Company merchandise purchases in person as well as online through our shop.
2. None of the benefits of the program will be available to me unless and until payment for the membership has posted. Once payment has cleared, all benefits go into effect. I understand that I will only be entitled to use membership benefits while the Family Business Beer Company’s premises is open to the general public.
3. I understand that my rights to the Beer for Life Program are conditional. Notwithstanding anything in this Agreement to the contrary, I will not have any rights to the benefits unless each of the following conditions is fully satisfied:
a. All benefits will be available to me subject to, and only in full compliance with, all applicable laws and regulations.
b. Official Family Member benefits may only be used when a Family Business Beer Company premises is open to the general public.
c. I must at all times while at a Family Business Beer Company premise (i) drink responsibly and in moderation, (ii) exercise good judgment, (iii) treat patrons, servers, bartenders and other people with courtesy and respect, (iv) not take any action that might jeopardize the health, welfare or safety of myself or any other person and (v) not engage in any harassment or violent or inappropriate conduct.
d. I must consume any pre-paid alcoholic beverages received from Family Business Beer Company on premises at said Family Business location.
e. I must not drive if unable to do so safely because of the consumption of alcoholic beverages or medication, or for any other reason.
f. I must present acceptable photo identification to Family Business staff as proof of identity and proof that I am over 21 years of age.
g. I must not appear intoxicated on the premises of any Family Business Beer Company location.
h. Unforeseen circumstances, including, for example, acts of God, inventory shortages, utility service interruptions, governmental actions, suspensions of licenses and acts of terrorism, may prevent or interfere with my use and enjoyment of Official Family Member benefits.
4. I understand that my participation in the Official Family Member program requires me to satisfy certain qualifications and acknowledge certain aspects of the program. I represent, acknowledge, and agree that:
a. I am over 21 years of age,
b. my status as an Official Family Member and my participation in the Free Beer for Life Program does not provide me with any managerial authority over any aspect of the business or operation of Family Business Beer Company.
c. I am not entitled to any discounts, free food and beverages or special services or treatment by Family Business Beer Company or Family Business staff, except as expressly set forth in this Agreement
d. I am participating voluntarily in the Free Beer for Life program, and you are not encouraging the excessive consumption of alcohol
e. Official Family Member benefits have no monetary value, are not redeemable for cash, are non-refundable, and are non-transferable
f. Family Business Beer Company reserves the right to modify the terms and conditions of the Official Family Member or Free Beer for Life membership program, including, without limitation, any terms and conditions of this Agreement, at any time or from time to time, without any compensation or refund to me. In furtherance and not in limitation of the foregoing, if, at any time, you determine in your sole and absolute discretion that my continued participation in the Free Beer for Life program is in any way harmful to the reputation, business or prospects of Family Business, including, for example, if I am charged or convicted of a crime involving dishonesty or moral turpitude, you may revoke all or any of my benefits as an Official Family Member in the Free Beer for Life program, and I will not be entitled to any compensation or refund.
5. I understand that the Official Family Member benefits are not transferable. Unless you give me your prior written consent, I am prohibited from directly or indirectly assigning, selling, encumbering, hypothecating or otherwise transferring or disposing of all or any part of my rights and obligations under this Agreement.
6. Family Business Beer Company reserves the right to cancel the Free Beer for Life program at any time for any reason.
7. Miscellaneous.
This Agreement and any claims associated herewith shall be governed by and construed in accordance with the internal laws of the State of Texas without giving effect to its choice of law provisions. This Agreement constitutes the entire agreement between us with respect to the subject matter hereof, and supersedes all prior agreements and understandings, if any, relating to the subject matter hereof. Nothing expressed or referred to in this Agreement will be construed to give any person, other than the parties to this Agreement, any legal or equitable right, remedy or claim under or with respect to this Agreement or any provision hereof. If any provision of this Agreement, including, without limitation, clause (f) of paragraph number 4, should be found by any court of competent jurisdiction to be invalid, illegal or incapable of being enforced, all other conditions and provisions of this Agreement will nevertheless remain in full force and effect. This Agreement shall be executed by me when I purchase my Official Family Member membership.
